Please read these Terms of Service ("Terms") carefully before using our website or services. These Terms govern your use of the website at ericscottstudios.com and any related services (the "Service"). If you engage us as a paying client, your services are also governed by our Master Service Agreement, which prevails over these Terms to the extent of any conflict for that relationship.

The Service is provided by TH Technology Ltd, a company registered in England & Wales (registered office: 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom), trading as "ES Studios" ("Company," "we," "us," or "our").

Acknowledgment

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part, you may not use the Service. You represent that you are at least 18 years old; the Company does not permit those under 18 to use the Service. Your use is also subject to our Privacy Policy, which explains how we collect, use, and disclose personal information.

Use of the Service

You agree to use the Service lawfully and not to misuse it, including by attempting to gain unauthorized access, interfering with its operation, or using it to infringe others' rights. We may modify, suspend, or discontinue any part of the Service at any time.

Intellectual property

The Service and its original content, features, and functionality are and remain the exclusive property of the Company and its licensors, and are protected by copyright, trademark, and other laws. You may not copy, reproduce, or create derivative works from our content without our prior written permission.

SMS messaging terms & compliance

We comply with all applicable laws and regulations, including the Telephone Consumer Protection Act (TCPA) and CTIA guidelines, regarding SMS communications.

• Program description. Our messaging program sends appointment confirmations, reminders, rescheduling updates, and customer-support communications to people who have booked with us or opted in through our web forms. Opt-in is collected via a dedicated SMS-consent checkbox.
• Opt-out. Text STOP to the number that messaged you to cancel at any time; we will confirm your unsubscribe by SMS. To rejoin, sign up again as you did originally.
• Help. Reply HELP, email team@ericscottstudios.com, or call +1 801-876-7399 during business hours.
• Rates & frequency. Message and data rates may apply; message frequency varies based on your usage and appointments. Contact your wireless provider about your plan.
• Carriers. Supported by major U.S. carriers (including AT&T, T-Mobile, Verizon) and most regional carriers. Carriers are not liable for delayed or undelivered messages.
• Age. You must be 18 or older to participate.
• Privacy. Opt-in data and consent records are kept confidential and are not shared with third parties or affiliates for marketing. See our Privacy Policy.

Links to other websites and third-party services

The Service may contain links to third-party websites or services we do not own or control, including content from third-party social-media services. We assume no responsibility for their content, policies, or practices, and are not liable for any damage or loss arising from your use of them. Your use of any third-party service is governed by that third party's terms and privacy policy.

Termination

We may terminate or suspend your access immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service ceases immediately.

"As is" and "as available" disclaimer

The Service is provided "AS IS" and "AS AVAILABLE," with all faults and without warranty of any kind. To the maximum extent permitted by law, the Company disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement, and does not warrant that the Service will be uninterrupted, secure, error-free, or free of harmful components. Some jurisdictions do not allow certain exclusions, so some may not apply to you.

Limitation of liability

To the maximum extent permitted by law, the Company's entire liability under these Terms, and your exclusive remedy, is limited to the amount you actually paid through the Service or US$100 if you have not purchased anything. In no event will the Company be liable for any indirect, incidental, special, or consequential damages (including loss of profits, data, or business interruption), even if advised of the possibility. Some states do not allow these limitations, in which case liability is limited to the greatest extent permitted by law.

Indemnification

You agree to indemnify and hold harmless the Company and its officers, employees, and agents from any claim or demand arising out of your use of the Service, your violation of these Terms, or your violation of any law or third-party right.

Governing law & dispute resolution

These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-laws principles, notwithstanding that the Company is registered in the United Kingdom. If you have a dispute, you agree first to try to resolve it informally by contacting us. Your use of the Service may also be subject to other local, state, national, or international laws.

United States legal compliance

You represent that you are not located in, and are not listed on any U.S. government list of prohibited or restricted parties in, a country subject to a U.S. government embargo or designated as supporting terrorism.

Severability & waiver

If any provision of these Terms is held unenforceable, it will be modified to achieve its intent as far as possible and the remaining provisions continue in effect. Our failure to enforce any right or provision is not a waiver of it.

Changes to these Terms

We may modify these Terms at any time at our sole discretion. If a change is material, we will make reasonable efforts to give at least 30 days' notice before it takes effect. By continuing to use the Service after changes become effective, you agree to the revised Terms.
